Warranty

This page explains your statutory guarantee rights as a consumer buying from fernandfog.ie, independently of any returns period or right of cancellation.

1. Your Statutory Guarantee

We are legally obliged to supply goods that conform with the contract, in accordance with the Consumer Rights Act 2022, which implements EU Directive 2019/771 on the sale of goods in Ireland. This means that goods must:

  • match the description we gave of them,
  • be fit for the purposes for which goods of that kind are normally used, and
  • be of satisfactory quality, taking into account their nature and any public statements made about them.

This guarantee applies for a minimum of two years from the date of delivery and exists automatically, by law – you do not need to register a product or pay for it separately. We do not currently offer any additional commercial warranty beyond this statutory guarantee.

2. Burden of Proof

If a lack of conformity becomes apparent within one year of delivery, it is presumed to have existed at the time of delivery, unless we can prove otherwise. After this first year, and up to the end of the two-year guarantee period, you may be asked to show that the fault was already present (even if not visible) when the goods were delivered.

3. Your Remedies

If goods turn out to be faulty or not as described, you are entitled, free of charge, to:

  1. have the goods repaired or replaced; or, if that is not possible or proportionate,
  2. receive an appropriate price reduction, or
  3. end the contract and receive a full or partial refund.

4. Natural Characteristics of Fine Art Prints

Our prints are produced using archival, museum-grade materials. Minor variations inherent to the fine-art printing process – for example, subtle colour or texture differences between individual prints, or natural variation in framing materials such as solid wood – are a natural characteristic of the product and are not considered a fault.

5. How This Differs from Your Right to Cancel

This statutory guarantee is separate from, and in addition to, your 14-day right to cancel an order for any reason, which is explained in our Cancellation Policy. The guarantee on this page applies for two years and covers faulty or non-conforming goods; it is not limited by the 14-day cancellation window.
